GENERAL TERMS AND CONDITIONS OF SALE — CONSUMERS

These terms apply to purchases made on deleurde.com by individuals acting outside their trade or profession. The seller is LAVERGNE ECOM, a French simplified joint-stock company (SAS), trading as Deleurde, with registered office at 1 ter impasse des Néfliers, 34130 Lansargues, France, SIREN 894 076 637, registered with the Montpellier Trade and Companies Register. Contact: support@deleurde.com. VAT not applicable pursuant to Article 293 B of the French General Tax Code.

1. Scope and acceptance

Placing an order entails acceptance of the version of these terms made available before confirmation. Mandatory consumer rights remain unaffected.

2. Products and availability

The essential characteristics, materials, dimensions and instructions are shown on each product page. Handmade products may display slight variations in colour, texture or dimensions. If an item becomes unavailable after ordering, Deleurde will inform you and refund the unavailable item unless you expressly accept an alternative.

3. Prices, taxes and charges

Consumer prices are displayed in the selected currency. VAT is not applicable pursuant to Article 293 B of the French General Tax Code. Delivery is free from €150 or USD 150, depending on the displayed currency. Below this threshold, charges are shown before payment. Any import duties or local taxes not collected at checkout are the recipient’s responsibility.

4. Orders

You select the products, review your basket, provide the necessary information and confirm payment. The contract is formed when the order is confirmed, subject to payment acceptance and any legitimate refusal permitted by law. Please correct any error before confirmation.

5. Payment

Available secure payment methods are displayed at checkout. Payment is due when the order is placed. Deleurde never asks you to send full card details by email.

6. Delivery

Available destinations, preparation times and estimated delivery times are shown at checkout or on the relevant product page. If delivery is materially delayed, you may require performance within a reasonable additional period and, where permitted by law, cancel the contract. Risk passes to the consumer when the goods are physically received.

7. Receipt, damage and non-conformity

Please inspect your parcel and report damage, missing items or errors promptly to support@deleurde.com, quoting the order number and providing useful photographs. This facilitates handling and does not reduce your statutory rights.

8. Right of withdrawal

Consumers generally have fourteen days from receipt to notify Deleurde of their withdrawal, then fourteen days to return the goods. Return costs are borne by the consumer unless otherwise stated or the product is defective. The standard outbound delivery charge is refunded. The right of withdrawal may not apply to goods made to your specifications or clearly personalised when this exception was disclosed before purchase.

9. Returns and refunds

Returned items must be protected appropriately. Refunds are made using the original payment method within the statutory period; Deleurde may defer reimbursement until the goods are recovered or proof of dispatch is provided. Discounted items remain covered by statutory withdrawal rights.

10. Statutory guarantees

Consumers benefit from the French statutory guarantee of conformity under Articles L. 217-3 et seq. of the Consumer Code and the guarantee against hidden defects under Articles 1641 et seq. of the Civil Code. The conformity guarantee may be invoked for two years from delivery. These guarantees apply independently of any commercial guarantee.

11. Product use and liability

Please follow the instructions and limitations stated for each item. Deleurde does not exclude liability where exclusion is prohibited, including for statutory guarantees, defective products, personal injury, fraud or gross negligence.

12. Intellectual property and data

Website content is protected by intellectual-property law. Personal data is processed in accordance with the Privacy Policy and cookie settings.

13. Complaints and mediation

Complaints may be sent to support@deleurde.com. Following an unsuccessful prior written complaint, a consumer may use the competent consumer mediator free of charge where applicable.

14. Governing law and disputes

French law applies without depriving consumers residing elsewhere of mandatory protections in their country. Competent courts are determined under applicable law.

15. Evidence and version

Electronic confirmations and order records may constitute evidence in accordance with the law. The applicable version is the one accepted when the order is placed.

GENERAL TERMS AND CONDITIONS OF SALE — PROFESSIONAL CUSTOMERS

1. Scope

These terms apply to customers purchasing for business purposes and prevail over their purchasing terms unless otherwise agreed in writing.

2. Commercial information and prices

Products, minimum quantities and prices are those in the applicable quotation, catalogue or offer. Prices are exclusive of tax; VAT is not applicable pursuant to Article 293 B of the French General Tax Code. Transport charges and any applicable duties are stated before commitment.

3. Quotations and orders

The validity period is stated on each quotation. An order becomes binding upon signature, electronic acceptance or the requested payment. Amendments or cancellation require Deleurde’s written agreement and may entail payment of costs already incurred.

4. Customisation and approval

The customer supplies usable files and guarantees the necessary rights. Production begins after payment and written approval of any proof. The customer must check dimensions, positioning, colour and spelling.

5. Payment

Unless agreed otherwise, payment is due before dispatch. Late payment automatically gives rise to statutory penalties and the €40 fixed recovery charge applicable between professionals.

6. Retention of title

Deleurde retains title until full payment of the price and related sums.

7. Delivery, transport and risk

Delivery arrangements, indicative timeframes and any Incoterm® 2020 are stated in the offer. The customer must inspect deliveries, make precise reservations to the carrier within the applicable period and notify Deleurde promptly.

8. Compliance and claims

Apparent or quantitative discrepancies should be reported with the reference, batch, invoice and evidence. Depending on the circumstances, Deleurde may replace, credit, correct or refund the affected goods, without prejudice to mandatory law.

9. Food-contact products

Where required, Deleurde provides available compliance, traceability and use information. The professional customer must observe and pass on relevant safety instructions.

10. Returns

Consumer withdrawal rights do not generally apply to B2B orders. Convenience returns require prior written agreement. Custom-made goods cannot be returned except for non-conformity, defect or written agreement.

11. Liability

Subject to mandatory law, liability is limited to direct, foreseeable loss arising from a proven breach. No limitation applies where prohibited by law.

12. Force majeure

Neither party is liable for failure caused by an event meeting the statutory test for force majeure. If it prevents performance on a lasting basis, either party may terminate the unperformed part, without prejudice to payment for work already completed.

13. Data, confidentiality and intellectual property

Professional contact data is processed under the Privacy Policy. Protected and confidential materials may be used only for the commercial relationship unless legally required or agreed in writing.

14. Law and jurisdiction

French law applies. Following an attempt at amicable resolution, disputes between traders fall within the jurisdiction determined by applicable rules and any valid agreed jurisdiction clause.

WEBSITE TERMS OF USE

1. Purpose and publisher

These terms govern access to deleurde.com, published by LAVERGNE ECOM under the Deleurde name.

2. Access

Access may be interrupted for maintenance, incidents, updates or events beyond reasonable control. Existing contracts and mandatory rights remain unaffected.

3. Accounts

You must provide accurate information, protect your credentials and report unauthorised access. An account may be suspended for fraud, security risks or serious breach.

4. Prohibited uses

You must not disrupt security or operation, introduce malicious code, scrape data without authorisation, impersonate others, circumvent access controls, act unlawfully or infringe third-party rights.

5. Content and intellectual property

Text, photographs, brands, logos, designs, videos and other content are protected. Use beyond statutory exceptions requires prior written permission.

6. Reviews and submitted content

You warrant that you hold the rights to submitted content and grant Deleurde a non-exclusive, royalty-free licence limited to publication, moderation and promotion connected with the service.

7. Information and external links

Deleurde endeavours to keep information accurate. External links are provided for convenience and do not affect mandatory pre-contractual duties or guarantees.

8. Security and liability

Reasonable security measures are used, but uninterrupted or threat-free access cannot be guaranteed. Liability is not excluded where prohibited by law.

9. Data and cookies

Data processing and trackers are described in the Privacy Policy and cookie-management tool.

10. Law and contact
