Terms of sale

These terms of sale are entered into between the individual company Deleurde, operating the website www.deleurde.com, hereinafter referred to as 'the Seller,' and any natural or legal person wishing to make a purchase via the website www.deleurde.com, hereinafter referred to as 'the Buyer.'

Article 1. Purpose

These terms of sale aim to define the contractual relationships between Deleurde and the Buyer and the conditions applicable to any purchase made through the website www.deleurde.com. The purchase of a product through this site implies unreserved acceptance by the Buyer of these terms of sale, which the Buyer acknowledges having read prior to placing an order. Before any transaction, the Buyer declares, on the one hand, that the purchase of products on the site www.deleurde.com is unrelated to their professional activity and is limited to strictly personal use, and on the other hand, that they have full legal capacity, enabling them to commit to these general terms of sale.

Deleurde reserves the right to modify these terms of sale at any time to comply with any new regulations or to improve the use of its website. Therefore, the applicable conditions will be those in effect on the date of the order by the Buyer.

Article 2. Products

The products offered are those listed on the website www.deleurde.com of the company Deleurde, within the limits of available stocks. Deleurde reserves the right to change the product assortment at any time. Each product is presented on the website in the form of a description that includes its main technical characteristics (capacity, use, composition, etc.). The photographs are as faithful as possible but do not engage the Seller in any way. The sale of the products presented on the website www.deleurde.com is intended for all buyers residing in countries that fully allow the entry of these products into their territory.

Article 3. Prices

The prices shown on the product pages of the internet catalog are in USD, including all taxes (VAT) applicable on the day of the order. Any change in the VAT rate may be reflected in the product prices. Deleurde reserves the right to change its prices at any time; however, the price listed in the catalog on the day of the order will be the only one applicable to the Buyer. The prices indicated do not include delivery charges, which are invoiced in addition to the product prices based on the total amount of the order. For metropolitan France, for any order greater than or equal to €50 including VAT, shipping is free. For any order less than 54USD including VAT, a flat-rate shipping fee of 5USD including VAT will be charged to the Buyer.

Article 4. Order and Payment Terms

Before placing an order, the Buyer must create an account on the website www.deleurde.com. The account creation section is accessible directly from the side menu bar. During each visit, if the Buyer wishes to order or consult their account (order status, profile, etc.), they must identify themselves using their login information. Deleurde offers the Buyer the option to order and pay for products in several steps, with three payment options to choose from:

  • Secure payment by Paypal or credit card (via the PayPal or Shopi Pay system): The Buyer selects the products they wish to order in the 'cart,' makes any necessary modifications (quantities, references, etc.), verifies the shipping address or enters a new one. Then, the shipping costs are calculated and presented to the Buyer, along with the name of the carrier. Next, the Buyer chooses their preferred payment method: 'Payment by Paypal.' The next step allows the Buyer to review all the information, read and accept these general terms of sale by checking the corresponding box, and then prompts them to confirm their order by clicking the 'Confirm My Order' button. Finally, the Buyer is redirected to the secure PAYPAL interface to securely enter their PayPal account or personal credit card details. If the payment is accepted, the order is recorded, and the contract is definitively formed. Payment by PayPal account or credit card is irrevocable. In the event of fraudulent use, the Buyer may demand the cancellation of the credit card payment, and the amounts paid will be credited or refunded. The cardholder is not liable if the disputed payment was proven to be fraudulent, made remotely, without physical use of the card. To obtain a refund of the fraudulent debit and any bank fees that may have been incurred, the cardholder must contest the charge in writing with their bank within 70 days of the transaction, or within 120 days if the contract with the bank provides for this. The amounts debited are refunded by the bank within a maximum period of one month after receiving the cardholder's written dispute. No fees for the restitution of sums will be charged to the cardholder.

Upon receipt of payment, the order will be processed, and the Buyer will be notified by email. Deleurde will process the order no later than 2 business days after receiving the corresponding payment, with reservations.

The confirmation of an order implies acceptance of these terms of sale, recognition of having read them thoroughly, and the waiver of any personal purchase conditions. All data provided and recorded confirmation will constitute evidence of the transaction. If the Buyer has an email address and has provided it on their order form, Deleurde will communicate the confirmation of the order's registration by email.

Article 5. Retention of Ownership

Deleurde retains full ownership of the products sold until the full payment, including the principal, fees, and taxes, is received.

Article 6. Right of Withdrawal

In accordance with Article L121-20 of the Consumer Code, the Buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and return the product to the seller for exchange or refund, without any penalty, except for return shipping costs.

Article 7. Delivery

Deliveries are made to the address indicated on the order form, which must be within the agreed-upon geographical area. Delivery times are provided for information only; if they exceed thirty days from the order date, the sales contract may be terminated, and the Buyer will be refunded. Deleurde may provide the Buyer with the tracking number of their package by email. The Buyer will be delivered to their home by their mail carrier. In the event of the Buyer's absence, they will receive a notice from their mail carrier, allowing them to pick up the ordered products at the nearest post office, within a timeframe specified by the postal services. The risks associated with transport are borne by the buyer from the moment the items leave Deleurde's premises. The Buyer is required to check the condition of the packaging and its contents in the presence of the postal worker or delivery person upon delivery. In the event of damage during transport, any claims must be made to the carrier within three days of delivery.

Article 8. Warranty

All products supplied by Deleurde are covered by the legal warranty provided for in articles 1641 and following of the Civil Code. In the event of non-compliance of a product sold, it may be returned to Deleurde, which will take it back, exchange it, or refund it. All claims, requests for exchange, or refund must be made by email to the following address: info@deleurde.com, within thirty days of delivery.

Article 9. Liability

In the process of distance selling, Deleurde is only bound by an obligation of means. Its liability cannot be engaged for any damage resulting from the use of the Internet network, such as data loss, intrusion, viruses, service interruption, or other inadvertent issues.

Article 10. Intellectual Property

All elements of the website www.deleurde.com are and remain the intellectual and exclusive property of Deleurde. No one is authorized to reproduce, exploit, or use, in any capacity, even partially, elements of the site, whether in the form of photos, logos, visuals, or text.

Article 11. Personal Data

Deleurde undertakes to preserve the confidentiality of information provided by the Buyer, which may be transmitted for the use of certain services. Any information concerning the Buyer is subject to the provisions of Law No. 78-17 of January 6, 1978. In this regard, the Internet user has a right of access, modification, and deletion of information concerning them. Article 12. Settlement of Disputes

These conditions of distance selling are subject to French law. For any disputes or litigation, the competent court will be the one in Marseille.
